Plaintiff’s father was on the shoulder of Interstate 15 inspecting a tire. When a young driver fell asleep at the wheel, swerved into the shoulder, struck Plaintiff’s father and killed him. The District Attorney charged the third party with gross negligence and vehicular manslaughter. Mr. Rose settled the civil portion of the case against the defendant for $1,497,000.00.

Details:
While unloading heavy grates from defendant’s truck, defendant negligently pushed the grates to the unprepared plaintiff. Plaintiff was not able to catch the grates. As a result, they slipped and fell onto his leg, causing severe injuries, including the formation of cellulitis. The wound became infected and doctors had to perform a skin graft. The plaintiff’s medical bills were significant. He also lost a significant amount of income because of his inability to work. After the third party insurance company paid it’s policy limits, Bouton brought a claim for Underinsured Motorist against USAA. Because the insurance company refused to honor his Underinsured Motor Claim, Mr. Rose filed an appeal. After winning at the court of Appeal, the insurance company filed for an appeal to the supreme court. The California Supreme Court, after years of appeals, finally sent to the case back to court for a trial. Two weeks before for the trial, the insurance company agreed to pay a confidential settlement.

A truck traveling on SR78 spilled its load leaving a bookcase on the freeway. Another car swerved to avoid hitting the debris and rammed into the car in which plaintiff was a passenger. The force of the impact caused plaintiff to be ejected from the vehicle. Plaintiff sustained major injuries as a result including traumatic injuries to his mouth requiring extensive repair to his teeth. He also suffered a severe concussion and memory loss. Due to his brain injury, doctors advised plaintiff to attend a program at Mesa College that rehabilitates individuals with brain injuries. Plaintiff’s medical bills exceeded $60,000. Plaintiff settled with the two carriers for the vehicle that spilled the load and for the vehicle that struck his vehicle for $15,000 each, and with his underinsured motorist policy for $90,000.
