SAN DIEGO ATTORNEY FOR VICTIMS OF UNDERINSURED & UNINSURED MOTORISTS

What does Uninsured (UM) and Underinsured (UIM) Coverage provide for?

When an uninsured motorist is at fault, the other party (not at fault) can make a claim to their own insurance company for their own benefits and/or injuries.

When an underinsured motorist is at fault, and the innocent party has policy limits that are higher than the at fault party’s limits, the innocent party can make a claim to their own insurance company (or the insurance company for the vehicle that they are in) for an amount beyond that of the at-fault party’s limits, up to the UIM limits available after deducting the money that you receive from the at-fault party.

There are many situations where people do not even realize that they are covered for by their own insurance company. Insured individuals can seek benefits for coverage under their UM / UIM when the following situations occur:

  • When there is not enough insurance from the person at fault, and your limits are higher.
  • When you are walking and struck by another vehicle.
  • When you are riding your bicycle and struck by a motor vehicle.
  • When you are driving a motorcycle.
  • When a family member in your household is injured from a motor vehicle collision.
  • When you are in another person’s vehicle.
  • When you are involved in a hit and run collision.

We explain to our clients that your own policy for Uninsured and Underinsured Motorist coverage follows you wherever you go, even if you are not in your own vehicle. As long as there is a connected motor vehicle collision or occurrence, you may be able to obtain benefits from your own insurance.
